TSS Visa

When they can’t locate an Australian with the necessary skills, firms might overcome labour shortages by hiring competent foreign workers. While guaranteeing that Australian workers are given preference, it permits the recruitment of foreign workers to meet momentary skill shortages. Holders of TSS visas are permitted to work in Australia in the profession of their choice and may have a path to permanent residency.

The TSS 482 visa comprises a three-step process:

Step 1: The employer must submit a sponsorship application (the employer needs to be a lawfull, active, operating business and meet local labour and employment practices).

Step 2: The second component of the application process is the nomination application. This is regarding the post to be filled, salary data, efforts to hire Australian workers and the ‘genuineness’ of the position. The company must also be profitable to be sponsored from abroad.

Step 3: This step is for the recommended employee to apply for a visa. The visa applicant must provide proof that they meet the qualifications for their profession, as well as the standards for fitness and moral character.

The TSS 482 visa offers three streams :

Short-term stream – this is for firms to obtain genuine temporary foreign skilled employees in occupations included on the Short-term Skilled Occupation List (STSOL) for a maximum of two years each time (or up to four years if an international trade requirement applies) (or up to four years if an international trade obligation applies)

Medium-term stream

Employers may use the medium-term stream to find highly qualified foreign workers to fill positions that are on the Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupations List (ROL) for up to four years at a time (each time), with eligibility to apply for permanent residence after three years.

Labour Agreement stream

On the basis of a demonstrable need that cannot be met in the Australian labour market and conventional visa programmes are not available, companies may use the Labour Agreement stream to find abroad skilled workers, with the potential to negotiate permanent residency.
